Conditions of Use
1. Scope of application
Services are rendered and deliveries made exclusively based on these terms. Any deviating provisions will be valid only if previously confirmed in writing by heeler-store.
2. Delivery service
For each order, we will charge a flat shipping rate of € 7. This shipping rate is charged only once if an order is delivered in several parts. Shipments abroad cost € 15 for Austria, Netherlands, Belgium € 15 for Switzerland, € 30 for USA and € 20 for all other countries. Shipments outside the federal republic of Germany will be made only against payment in advance.
Any obligation on our part to fill orders for articles is subject to availability, i.e. only as long as the article is on stock in the size and colour you have ordered. If delivery is not possible or not until a later date, we will of course let you know and reimburse any advance payments made immediately.
As a matter of principle, delivery dates communicated by us are not binding, but deliveries in Germany are usually made within 3 to 5 business days if the merchandise is on stock. Again, these are approximate times given without commitment on our part. Something else applies only when a delivery date was confirmed as a fixed date by heeler-store in a written individual agreement.
3. Payment service
All prices quoted include the legal vat. You can choose which way you would like to pay - by advance payment, credit card (master-/eurocard, visa, diner's) b via Paypal or cash on delivery. All prices are quoted in the confirmation of the order and are due when the order is placed or delivered, respectively. The prices quoted in our catalogues and flyers are valid only until publication of the next catalogue or flyer. If you order from our website, the prices shown there on the order date are applicable.
4. Return privilege
You have an unrestricted privilege to return the merchandise within 14 days after receipt. you will observe this time limit by mailing merchandise that may be sent in a package within that time period or, if the merchandise cannot be sent in a package, by sending a written return request to Wohak GbR, Ziethenstr. 10a, 53842 Troisdorf will bear the costs for such return mailings. If you exercise your return privilege, the contract of sale becomes void. However, articles we have made for you especially, for example, jerseys with individual numbers, and videos will not be accepted for return.
If you rescind from the sales contract or exercise the 14-day privilege of return, we reserve the right to claim adequate compensation for the deterioration in value resulting from use of the product. This also applies if you have handled the merchandise carefully. You can avoid having to make such compensation by not using the merchandise during the time in question.
5. Warranty
The legal warranty is 2 years and begins when the merchandise is handed over. During that time, we will remedy all defects subject to the legal warranty at no cost to you. Please report such defects immediately to the delivery agent or heeler-store; obvious defects must be reported within 14 days from receipt of the merchandise.
Initially, you may claim rectification. If this fails, you may choose between rescission from the contract or reduction of the purchase price and damage compensation as far as permitted by law.
Please keep in mind, however, that normal wear is not covered by warranty. Wheels are not with guarantees.
If any particular article cannot be delivered, we will send you a replacement, which is equivalent with regard to quality and price. You may return this replacement article within 14 days if you do not like it. If no replacement article is available, heeler-store is released from the obligation to deliver. In such cases, we are obliged to inform you immediately and to return any payments you have made already.
6. Set-off
Persons placing an order only have a right to set-off if their counter-claims have been validly established and recognised by heeler-store.
7. Right of rescission of heeler-store
In case of typing/printing errors or miscalculations on the website or in catalogues or flyers, heeler-store is entitled to rescission from contracts based on such errors.
8. Reservation of ownership
Heeler-store reserves ownership of any merchandise bought until the merchandise in question and all other articles from the same shipment have been paid for in full.
9. Data protection
We will process personal data provided to us in connection with your order. We undertake to treat these data in confidence and not to pass them to third parties. Unless we hear from you to the contrary, we will assume that you have no objection to receiving offers for new heeler-store offers by post or e-mail.
10. Jurisdiction
As far as admissible, the court in Siegburg shall have jurisdiction for all disputes.
11. Applicable law
German law is applicable exclusively, un sales law being ruled out. This also applies if your personal address for service is abroad.
12. Safeguarding clause
If any one of the above provisions should be or become invalid, the other clauses remain valid.
